Fair Access Policy
The Service uses resources that are shared with many users. The Service also provides access to the Internet which is used by millions of others. Each user of the Service benefits by being able to share resources and communicate with other members of the user community. However, as with any community, the benefits and privileges available from the Service, and the Internet in general, must be balanced with duties and responsibilities designed to ensure uniform access to all users of the Service.
1. Policy. This Policy is subject to the definitive agreement made between Telesat and the reseller of the Service from Telesat (“Northwestel Cable Inc”) which governs the provision of Service to Northwestel Cable Inc. and its users. Northwestel Cable Inc. shall strictly abide by the terms of this Policy and shall use reasonable commercial efforts to enforce all provisions of this Policy with its Subscribers and users. All Subscribers and users shall strictly abide by the terms of this Policy.

Northwestel Cable Inc. and all users hereby authorize Telesat to cooperate with (i) law enforcement authorities in the investigation of suspected criminal violations, and/or (ii) system administrators at other Internet service providers or other network or computing facilities in order to enforce this Policy.
The failure of Telesat to enforce this Policy, for whatever reason, shall not be construed as a waiver of any right to do so at any time.
If any portion of this Policy is held invalid or unenforceable, that portion will be construed consistent with applicable laws as nearly as possible, and the remaining portions will remain in full force and effect.
